This Notice is issued pursuant to the Personal Data Protection Act 2010 (PDPA). The main purpose of this notice is to make you better understand the reasons and purposes of the collection of personal data by Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. and DKSH as well as both organization’s commitment to ensure that your data is securely processed and kept. We believe that our customers have an expectation to understand how their personal data is handled. It is part of our Companies values that all personal data and privacy of our customers are treated with care and respect. The security of your personal data is important to us.
Collection of Personal Data
DKSH is the appointed program administrator by Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. and will be executing Program enrollment and management (“Purpose”). DKSH will collect and process your personal data for the said Purpose. No identifiable data will be shared to Dr.Reddy’s Laboratories Malaysia Sdn. Bhd.
Generally, we collect Personal Data in the following ways:
when you interact with us via our websites or use services on our websites;
when you submit any forms/details relating to any of our services directly to us or to your treating doctor/healthcare professionals/hospital appointed personnel (if applicable) for purposes in relation to this program;
when you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our services;
when you interact with our staff for example via telephone/video calls (which may be recorded), letters, fax, face-to-face meetings, text messages and emails relating to any of our services; and
when you submit your Personal Data to us for any other reasons.
If you provide us with any Personal Data relating to a third party/care giver (e.g. information of your spouse, children, parents, and/or employees), by submitting such information to us, you represent to us that you have obtained the consent of the third party to provide us with their Personal Data for the respective purposes.
You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with the products and services you have requested, or delays in providing you with products and services you have requested or processing your applications.
Under the Program, DKSH Distribution Malaysia Sdn. Bhd. (197401004367 (21554-V)) (“DKSH”), is responsible for the collection and processing of your personal data. DKSH will then provide aggregated data report with no patient identifiable details to Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. as the “ Joint Data User”.
Type of Personal Data to be collected under the Program:
For this Purpose, DKSH will collect and process the following personal data about you through DKSH PSPhere:
Name, Email Address and Mobile Number, Healthcare Institution, Identification Card number or Passport number, Age, Gender, Indication, Dosage, Prescription and treatment details.
Please refer to the DKSH PSPhere Privacy Notice for further details on cookies and other technologies tracking collection and processing by DKSH solely for its purpose.
After initial data collection, DKSH will have each patient file pseudonymized (replacing name with artificial identifier e.g., coded identification number). The Program Owner, Dr.Reddy’s Laboratories Malaysia Sdn. Bhd., will only receive coded and aggregated data for Program monitoring purpose.
Importance of Providing Personal Data
We would like you to understand that it is important for you to provide the necessary personal data to us to facilitate your participation in this program and any relevant relationship between you and DKSH or Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. All information requested is obligatory to be provided by you unless stated otherwise. Should you fail to provide the obligatory information, we may be unable to process your request and/or provide you with relevant services or products.
How is your data used in the Program
As Joint Data User, Personal Data provided by you will be collected, used and otherwise processed by DKSH for the following purposes:
Administering and processing your requests including creating and maintaining profiles of our customers in our system database for purposes relating to the Program such as enrollment and roll-off of patients;
Responding to, processing and handling your queries, feedback, complaints and requests;
Interacting with you when necessary (e.g. to discuss the Adverse Events in further details);
Managing our relationship pertaining to the Program with you;
To deliver the service or products as required by your participation in the Program;
Liaising with third party specialist doctors, clinics, hospitals and/or medical institutions in relation to your medical care (including by providing them with access to your medical records)
Our internal record keeping;
Meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group; and
Other reasons that are permitted under PDPA or other applicable laws/guideline/circular/code applicable.
Access to Personal Data and with Whom Your Personal Data will be shared and/or transferred
to:
DKSH will have access to your personal data. Additionally, Dr.Reddy’s Laboratories Malaysia Sdn. Bhd.’ authorized third parties and DKSH’s affiliate and authorized third party (Zelthy, the cloud provider) will have access to / share / disclose your personal data.
The Joint Data User will not sell, share, or otherwise transfer your personal data. The authorized third party are contractually obliged to protect the confidentiality and security of your personal data, in compliance with PDPA.
Please take note that your personal data may be stored in cloud-based services physically located in Singapore. Additionally, a Joint Data User and its authorized third party may share your data with a number of authorized recipients (including affiliates) located outside Malaysia which the receiving country law may not offer the same level of protection of personal data. The Joint Data User will make sure to protect your personal data by (i) applying the level of protection required under PDPA and (ii) acting in accordance with respective internal data privacy and protection policies and standards.
Any other party to whom you authorise us to disclose your Personal Data to.
Technical and Organization Measure to Protect:
Joint Data User have implemented appropriate technical and organizational measures to provide an adequate level of security and confidentiality to your personal data as required under PDPA. The purpose thereof is to protect it against accidental or unlawful accidental loss, unauthorized disclosure, or access and against other unlawful forms of processing, destruction, or alteration.
Retention of Your Personal Data:
Joint Data User will only retain your personal data for as long as necessary to fulfil the purpose forwhich it was collected under this Program and to comply with any legal or regulatory requirements. When this period expires, your personal data is kept for a further 10 years for purposes relating to this program. Thereafter, your personal data will be securely disposed of or anonymized.
Your Data Subject Right:

Right to Access your personal data processed by Joint Data User and its authorized third party, and if you believe that any information relating to you is incorrect, obsolete or incomplete, request for its Correction or updating; and
Right to Withdraw your consent on participating in the program and processing of your dataanytime, without affecting the lawfulness of processing before such withdrawal and subsequent data retention in accordance to applicable local law;
We will not process your personal data if we do not have a proper justification foreseen in the law for that purpose. Therefore, we only process your personal data if we have obtained your prior consent. We would also like to highlight that at no point we shall process your personal data for direct marketing purposes. Having said that, please take note below are your data subject rights in addition to the above mentioned:
Right to Prevent Processing likely to cause damage or distress;
Right to Prevent Processing for Direct Marketing purpose; and
Right to File a Complaint with the competent data protection authorities.

Pengumpulan Data Peribadi
DKSH ialah pentadbir program yang dilantik oleh Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. dan akan melaksanakan pendaftaran dan pengurusan Program (“Tujuan”). DKSH dan Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. akan bersama-sama mengumpul dan memproses data peribadi anda untuk Tujuan tersebut.

apabila anda berinteraksi dengan kami melalui laman web kami atau menggunakan perkhidmatan di tapak web kami;
apabila anda menyerahkan sebarang borang/butiran yang berkaitan dengan mana-mana perkhidmatan kami secara terus kepada kami atau kepada doktor yang merawat/profesional penjagaan kesihatan/kakitangan yang dilantik di hospital (jika berkenaan) untuk tujuan berkaitan program ini.

Jenis Data Peribadi yang akan dikumpul di bawah Program:
Untuk Tujuan ini, DKSH akan mengumpul dan memproses data peribadi berikut tentang anda melalui DKSH PSPhere:
Nama, alamat emel dan nombor telefon bimbit, Institusi Kesihatan, nombor kad pengenalan atau nombor pasport, umur, jantina, indikasi, dos, preskripsi dan butiran rawatan.
Sila rujuk kepada Notis Privasi DKSH PSPhere untuk butiran lanjut tentang kuki dan teknologi lain yang menjejaki pengumpulan dan pemprosesan oleh DKSH semata-mata untuk tujuannya.
Selepas pengumpulan data awal, DKSH akan menjadikan setiap fail pesakit diberi nama samaran (menggantikan nama dengan pengecam buatan cth., nombor pengenalan berkod). Pemilik Program, Dr.Reddy’s Laboratories Malaysia Sdn. Bhd., hanya akan menerima data berkod dan agregat untuk tujuan pemantauan Program.
Kepentingan Menyediakan Data Peribadi
Kami ingin anda memahami bahawa adalah penting bagi anda untuk memberikan data peribadi yang diperlukan kepada kami untuk memudahkan penyertaan anda dalam program ini dan sebarang hubungan yang berkaitan antara anda dan DKSH atau Dr.Reddy’s Laboratories Malaysia Sdn. Bhd.. Semua maklumat yang diminta adalah wajib diberikan oleh anda melainkan dinyatakan sebaliknya. Sekiranya anda gagal memberikan maklumat wajib, kami mungkin tidak dapat memproses permintaan anda dan/atau memberikan anda perkhidmatan atau produk yang berkaitan.
Bagaimanakah data anda digunakan dalam Program
Sebagai Pengguna Data Bersama, Data Peribadi yang anda berikan akan dikumpul, digunakan dan sebaliknya diproses oleh DKSH untuk tujuan berikut:
Mentadbir dan memproses permintaan anda termasuk membuat dan mengekalkan profil pelanggan kami dalam pangkalan data sistem kami untuk tujuan yang berkaitan dengan Program seperti pendaftaran dan pelepasan pesakit;
Menjawab, memproses dan mengendalikan pertanyaan, maklum balas, aduan dan permintaan anda;
Berinteraksi dengan anda apabila perlu (cth. untuk membincangkan Peristiwa Buruk dengan butiran lanjut);
Menguruskan hubungan kami yang berkaitan dengan Program dengan anda;
Untuk menyampaikan perkhidmatan atau produk seperti yang diperlukan oleh penyertaan anda dalam Program;
Berhubung dengan doktor pakar, klinik, hospital dan/atau institusi perubatan pihak ketiga yang berkaitan dengan penjagaan perubatan anda (termasuk dengan memberikan mereka akses kepada rekod perubatan anda)
Memenuhi sebarang keperluan undang-undang atau peraturan berkaitan dengan penyediaan perkhidmatan dan produk kami dan untuk membuat pendedahan di bawah keperluan mana-mana undang-undang, peraturan, arahan, perintah mahkamah, undang-undang kecil, garis panduan, pekeliling, kod yang terpakai kepada kami atau mana-mana syarikat ahli kumpulan kita; dan
Sebab lain yang dibenarkan di bawah PDPA atau undang-undang/garis panduan/pekeliling/kod lain yang berkenaan.
Akses kepada Data Peribadi dan dengan Siapa Data Peribadi Anda akan dikongsi dan/atau dipindahkan:
DKSH akan mempunyai akses kepada data peribadi anda. Selain itu, pihak ketiga yang diberi kuasa oleh Dr.Reddy’s Laboratories Malaysia Sdn. Bhd. dan ahli gabungan DKSH dan pihak ketiga yang dibenarkan (Zelthy, penyedia awan) akan mempunyai akses kepada / berkongsi / mendedahkan data peribadi anda.
Pengguna Data Bersama tidak akan menjual, berkongsi, atau sebaliknya memindahkan data peribadi anda. Pihak ketiga yang diberi kuasa bertanggungjawab secara kontrak untuk melindungi kerahsiaan dan keselamatan data peribadi anda, dengan mematuhi PDPA.
Sila ambil perhatian bahawa data peribadi anda mungkin disimpan dalam perkhidmatan berasaskan awan yang terletak secara fizikal di Singapura. Selain itu, Pengguna Data Bersama dan pihak ketiga yang diberi kuasa boleh berkongsi data anda dengan beberapa penerima yang dibenarkan (termasuk ahli gabungan) yang terletak di luar Malaysia yang undang-undang negara penerima mungkin tidak menawarkan tahap perlindungan data peribadi yang sama. Pengguna Data Bersama akan memastikan untuk melindungi data peribadi anda dengan (i) menggunakan tahap perlindungan yang diperlukan di bawah PDPA dan (ii) bertindak mengikut dasar dan piawaian privasi dan perlindungan data dalaman masing-masing.
Mana-mana pihak lain yang anda memberi kuasa kepada kami untuk mendedahkan Data Peribadi anda.
Langkah Teknikal dan Organisasi untuk Melindungi:
Pengguna Data Bersama telah melaksanakan langkah teknikal dan organisasi yang sesuai untuk menyediakan tahap keselamatan dan kerahsiaan yang mencukupi kepada data peribadi anda seperti yang diperlukan di bawah PDPA. Tujuannya adalah untuk melindunginya daripada kehilangan kemalangan yang tidak disengajakan atau menyalahi undang-undang, pendedahan tanpa kebenaran, atau akses dan terhadap bentuk pemprosesan, pemusnahan atau pengubahan yang menyalahi undang-undang lain.
Pengekalan Data Peribadi Anda:
Pengguna Data Bersama hanya akan menyimpan data peribadi anda selama yang diperlukan untuk memenuhi tujuan ia dikumpulkan di bawah Program ini dan untuk mematuhi sebarang keperluan undang-undang atau peraturan. Apabila tempoh ini tamat, data peribadi anda disimpan selama 10 tahun lagi untuk tujuan yang berkaitan dengan program ini. Selepas itu, data peribadi anda akan dilupuskan dengan selamat atau tanpa nama.

Hak untuk Mengakses data peribadi anda yang diproses oleh Pengguna Data
Bersama dan pihak ketiga yang diberi kuasa, dan jika anda percaya bahawa sebarang maklumat yang berkaitan dengan anda adalah tidak betul, lapuk atau tidak lengkap, minta Pembetulan atau pengemaskiniannya; dan
Hak untuk Menarik balik persetujuan anda untuk menyertai program dan memproses data anda pada bila-bila masa, tanpa menjejaskan kesahihan pemprosesan sebelum pengeluaran tersebut dan pengekalan data seterusnya mengikut undang-undang tempatan yang terpakai;
Kami tidak akan memproses data peribadi anda jika kami tidak mempunyai justifikasi yang sepatutnya diramalkan dalam undang-undang untuk tujuan itu. Oleh itu, kami hanya memproses data peribadi anda jika kami telah mendapat kebenaran anda terlebih dahulu.
